The PVG Scheme in Scotland: What Care Employers Need to Know

PVG became a legal requirement in 2025 with criminal penalties for non-compliance, and free applications launched for social care workers in August 2026. What Scottish care employers need to know.

Scotland runs its own vetting and barring system for anyone working with children or protected adults, and since April 2025 it has stopped being something employers could treat as good practice and become a legal requirement with criminal penalties attached. For care providers already juggling Care Inspectorate Scotland's training expectations, the PVG scheme is a separate compliance obligation that sits alongside inspection readiness rather than inside it — and getting it wrong now carries consequences well beyond a poor inspection finding.

What the PVG scheme actually is

The Protecting Vulnerable Groups (PVG) scheme, run by Disclosure Scotland, is Scotland's system for vetting people who work or volunteer in "regulated roles" with children, protected adults, or both. Membership is ongoing rather than a one-off check: once someone joins the scheme, Disclosure Scotland continuously monitors new criminal history and other relevant information against their record, and can update or flag it at any point rather than waiting for a fresh application. Regulated roles cover a wide range of positions across health, social care, sport, foster care and community groups. Disclosure Scotland provides a role checker tool specifically because the boundary isn't always obvious — a role can be regulated even where the job title doesn't sound like frontline care work.

From 1 April 2025, individuals carrying out a regulated role with children, protected adults, or both must be a member of the PVG scheme, and organisations must ensure the people they place in those roles meet that requirement. The change also replaced the old "regulated work" terminology with "regulated roles" and widened the scope to bring in some positions — including certain hospital and hospice-based roles — that weren't previously covered.

A three-month grace period ran until 30 June 2025. Since 1 July 2025, it has been a criminal offence for someone to carry out a regulated role without PVG membership, and an offence for an organisation to allow them to. The maximum penalty is five years' imprisonment, an unlimited fine, or both — a materially higher-stakes compliance gap than a missed training deadline, and one worth flagging explicitly to any manager who assumes PVG is "just paperwork."

Free PVG applications for social care workers

From 1 August 2026, the Scottish Government waived PVG application fees for eligible social care workers starting a new job or new position with their current employer in the private, voluntary or independent sector, provided the application is made on or after that date. The waiver runs for a year, through 31 July 2027, and sits alongside the existing position that PVG applications remain free for volunteers across all sectors. For employers, this removes one of the practical friction points that sometimes slowed down PVG applications for new starters — there's no cost barrier left to justify delaying an application once someone has accepted a role.

What this means for onboarding and ongoing compliance

Two separate obligations now sit on every care employer in Scotland: confirming PVG membership before someone starts in a regulated role, and monitoring that membership doesn't lapse or generate a new disclosure that needs acting on. Given the criminal liability introduced in 2025, PVG status deserves the same pre-employment rigour as right-to-work checks — verified before day one, not chased up afterwards. It's also worth building PVG verification into the same onboarding checklist as any Scotland-specific induction requirements, so a new starter's compliance paperwork is handled as one process rather than several separate ones running in parallel.

Is the PVG scheme the same as an England DBS check?
They serve a similar purpose — vetting people for roles involving children or vulnerable adults — but they're separate legal schemes. Does the free PVG application waiver apply to all care roles?
